1. Scope
These Terms of Service govern the use of the schwiizerdütsch.com API, dashboard, and all associated services ("Services") provided by Andrin Iten & Max Diez ("we", "us"). By using our Services you agree to these terms.
2. Account and security
You are responsible for keeping your API keys and account credentials secure. Notify us immediately at andrin@iten.to if you suspect unauthorised access. You are liable for all activity under your account.
3. Licence
We grant you a non-exclusive, non-transferable, revocable licence to use the Services for private, non-commercial purposes only. You may edit the generated audio, integrate it into non-commercial projects, and share it non-commercially. Any commercial use of the generated output is prohibited. Background: the model was trained in part on the SwissDial dataset (ETH Zürich), licensed under CC BY-NC 4.0. For commercial enquiries: andrin@iten.to.
4. Free use
The Services are currently free of charge. There are no paid plans and no billing. To keep the service fair, usage quotas apply (e.g. characters per day); exceeding a quota throttles the API rather than blocking it. We may adjust quotas at any time.
5. Prohibited uses
You may not use our Services to:
- Use the generated output or the Services commercially (see section 3)
- Generate voice content intended to deceive or impersonate individuals without consent
- Create deepfakes or non-consensual synthetic media
- Produce content that violates applicable law or third-party rights
- Attempt to reverse-engineer, extract, or replicate our models
- Circumvent rate limits or access controls
- Resell API access
- Generate spam, automated abuse, or illegal content
6. Intellectual property
All models, software, and technology underlying the Services remain our exclusive property. You retain ownership of the text you submit and the audio generated from it.
7. Availability
We aim for high availability but do not guarantee uninterrupted service. We reserve the right to perform maintenance with reasonable notice where possible.
8. Limitation of liability
The Services are provided "as is" and free of charge. To the maximum extent permitted by Swiss law, our liability is excluded. In particular, we are not liable for indirect, consequential, or incidental damages. This exclusion does not apply in cases of intent or gross negligence.
9. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of the Services in violation of these terms or applicable law.
10. Privacy
Your use of the Services is governed by our Privacy Policy.
11. Termination
You may cancel your account at any time via the dashboard. We may terminate or suspend access with immediate effect for material breach of these terms. Upon termination, your account data will be deleted within 30 days.
12. Changes
We may update these terms with 30 days' notice by email or notice on our website. Continued use of the Services constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by Swiss law. The exclusive place of jurisdiction for any disputes is Zurich, Switzerland, subject to mandatory consumer protection provisions.
14. Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force.
