1. Scope
These Terms of Service govern the use of the schwiizerdütsch.com API, dashboard, and all associated services ("Services") provided by Andrin Iten & Max Diez ("we", "us"). By using our Services you agree to these terms.
2. Account and security
You are responsible for keeping your API keys and account credentials secure. Notify us immediately at andrin@iten.to if you suspect unauthorised access. You are liable for all activity under your account.
3. Licence
We grant you a non-exclusive, non-transferable, revocable licence to use the Services. The rights you hold in the generated audio depend on the voice you use:
All available voices are cleared for commercial use: generated output may be used commercially, edited and integrated into your products. The clearance is visible on every voice, as a marker in the studio, in the commercial_use field of /v1/voices, and in the X-Commercial-Use response header of /v1/speak.
In both cases you may not resell the voices themselves, offer them as your own speech synthesis service, or use the output to train models.
4. Credits and payment
Usage is billed via credits. One character of input text equals one credit; the length of the text you submit is what counts. The price is CHF 0.40 per 1,000 characters; credit packages start at CHF 10. Every new account receives a one-off starting credit of 600 characters to try the service; it may be adjusted or discontinued for the future at any time.
Credits are purchased upfront in packages, processed by our payment provider Stripe. Purchased credits do not expire and are not refundable in cash, except where required by law. If your balance is insufficient for a request, that request is rejected. If a generation fails technically, the credits charged for it are automatically restored.
We may adjust prices and packages going forward. Credits already purchased are unaffected.
5. Prohibited uses
You may not use our Services to:
- Generate voice content intended to deceive or impersonate individuals without consent
- Create deepfakes or non-consensual synthetic media
- Produce content that violates applicable law or third-party rights
- Attempt to reverse-engineer, extract, or replicate our models
- Circumvent rate limits or access controls
- Resell API access
- Generate spam, automated abuse, or illegal content
6. Intellectual property
All models, software, and technology underlying the Services remain our exclusive property. You retain ownership of the text you submit and the audio generated from it.
7. Availability
We aim for high availability but do not guarantee uninterrupted service. We reserve the right to perform maintenance with reasonable notice where possible.
8. Limitation of liability
The Services are provided "as is". To the maximum extent permitted by Swiss law, our liability is limited to the amount of credits purchased in the preceding twelve months. In particular, we are not liable for indirect, consequential, or incidental damages. This exclusion does not apply in cases of intent or gross negligence.
9. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of the Services in violation of these terms or applicable law.
10. Privacy
Your use of the Services is governed by our Privacy Policy.
11. Termination
You may cancel your account at any time via the dashboard. We may terminate or suspend access with immediate effect for material breach of these terms. Upon termination, your account data will be deleted within 30 days.
12. Changes
We may update these terms with 30 days' notice by email or notice on our website. Continued use of the Services constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by Swiss law. The exclusive place of jurisdiction for any disputes is Zurich, Switzerland, subject to mandatory consumer protection provisions.
14. Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force.
